Florida voters reject Amendment 3 to legalize recreational marijuana

A $150 million-plus effort to allow recreational use of marijuana in Florida fizzled out Tuesday, falling short of the needed 60 percent voter approval and delivering a major victory for Gov. Ron DeSantis.

Trulieve, the state’s largest medical-marijuana operator, pumped nearly $144.6 million into the proposed constitutional amendment. The Quincy-based company’s contributions made up more than 94 percent of the overall total of $152.27 million in cash raised by the Smart & Safe Florida political committee that sponsored the measure, which appeared as Amendment 3 on the ballot.

Cannabis Use and Schizophrenia
Using Danish health records for over six million individuals, one study found that as many as 30% of cases of schizophrenia among men aged 21 to 30 could have been prevented had they avoided cannabis use disorder. The study author, however, flagged that Denmark does not have as much diversity as the US and that genetics do play a role in schizophrenia risk. Is it Legal to Ship Cannabis Seeds in the United States?

Maryland and Minnesota just got legalized and there’s a ton of new growers who have a healthy fear of what is legal or not when it comes to shipping cannabis seeds. Marijuana or “marihuana” is listed as a Schedule 1 drug under the controlled substance Act. Marijuana is defined by the controlled substance act as All parts of the plant Cannabis sativa L., whether growing or not; the seeds thereof; the resin extracted from any part of such plant; and every compound, manufacture, salt, derivative, mixture, or preparation of such plant, its seeds or resin.

Both the United States Post Office and Customs agree that shipping cannabis seeds from state to state and into the country is 100% legal.

However, In the United States, the legal status of possessing cannabis seeds varies from state to state. While some states have fully legalized cannabis for both medical and recreational use, others maintain strict prohibitions.

The 2018 Farm Bill, which legalized industrial hemp, classifies hemp as cannabis with less than 0.3% THC content. Since hemp is federally legal, cannabis seeds fall into that classification and is excluded from the Controlled Substance Act.

It is important to exercise caution, as interpretations of federal and state laws can vary. Some states explicitly criminalize the sale and possession of cannabis seeds, even if they do not contain THC.

The legal landscape surrounding cannabis is always changing but my site will always try to stay up to date on it. Some states that previously had strict regulations against cannabis may have changed their laws or regulations since my last update. Additionally, other states may have specific regulations or restrictions on cannabis seeds that are not explicitly mentioned here.

As of my knowledge from research done on August 11th, 2023, The following states are illegal:

Idaho: Idaho has maintained a very strict stance against cannabis. “A producer license authorizes a person or entity to obtain and possess hemp seed for planting; to cultivate and harvest hemp; to transport their own hemp crop; to dispose of or remediate their own hemp; as well as possess and market plant parts.

Kentucky Prohibits Cannabis Seeds, Hemp too: https://www.kyagr.com/marketing/hemp-law.html
Even though the 2018 Farm Bill removes hemp from the controlled substance list, no person can grow, handle (possess), or process hemp plants, viable seed, leaf or floral materials without a hemp license issued by the Kentucky Department of Agriculture.

There are few places in the world where you can walk into a licensed shop and buy marijuana for recreational use. Uruguay is one (sold in pharmacies). Canada is another. They’re joined by 21 US states, representing 48 percent of the American population, up from zero states in 2013.

That means that in Idaho, people caught growing or selling weed face mandatory jail time and tens of thousands of dollars in fines while their counterparts next door in Washington can enroll in a state-funded mentor-ship program for cannabis business planning and development. And states like Washington are violating both US federal law which prohibits any use of marijuana, and also international law, which prohibits non-medical uses.

That’s messy. But it reflects that although large majorities agree that the criminalization of cannabis use was a mistake, there’s less consensus about how exactly to move forward.

Will Jones III, the Director of Community Engagement & Outreach at Smart Approaches to Marijuana (SAM), maintains that the commercialization of weed would lead to more harm than good. He prefers decriminalization instead, which removes criminal penalties, treating marijuana possession more like a traffic ticket. (Six US states have decriminalized recreational cannabis without legalizing.) However, SAM prioritizes fighting legalization and reducing drug use over promoting decriminalization.

SAM co-drafted the Medical Marijuana and Cannabidiol Research Expansion Act which makes it easier to study marijuana and develop marijuana-derived drugs but without descheduling marijuana as a schedule I illicit substance. President Biden signed it into law in December of 2022.

Paul Armentano, the Deputy Director of NORML, has spent decades advocating for legalization of marijuana and says decriminalization doesn’t go far enough. NORML represents the interests of cannabis consumers and has been advocating for the removal of criminal penalties for recreational marijuana since 1970.

We thought both of their perspectives were worth hearing but didn’t want to stage a traditional debate where viewers so often come away confused about what to believe. So we created a format that would help establish a shared foundation of facts while still communicating what each of these advocates believe is the most important information to know.

In this new take on a debate, we asked both participants to identify facts that their opponent would have to concede are true. They were given an opportunity to review their adversary’s facts in advance and in a video call agreed on a set of six. In the video, you’ll see those facts presented, with each participant given the opportunity to add a “footnote” to their opponent’s facts.

On November 3, four American states voted to legalize marijuana: Arizona, New Jersey, Montana and South Dakota. Combined with the other states that have done so in recent years, one in three Americans now live in a state where access to marijuana has been legalized. It shows that Americans are souring on the harsh drug policies that have put millions of people in prison.

But America’s national drug policy is a different story. Under federal law, marijuana is still classified as a “schedule 1” drug, meaning it’s considered to have little medical value and a high risk of abuse, along with drugs like LSD, heroin, ecstasy and psilocybin mushrooms. In states where marijuana has been legalized, that conflict with federal law creates numerous problems for legal marijuana sellers and users. And few national politicians talk about legalizing marijuana throughout the country. But advocates are hoping that by introducing new state laws one by one, Americans who are ready to move on from the country’s decades-long war on drugs will eventually force the federal government’s hand.
