But that timeline just changed.

Congress has now passed (and Trump has signed) legislation delaying the ban until December 11, giving lawmakers more time to work on a regulatory framework for hemp-derived THC products.

Why do Marijuana Arrests Still Make up 1 in 4 Nationwide? | TDR Cannabis in 5

Nearly one in four drug arrests nationwide are still for marijuana possession.

In this episode of TDR Cannabis in 5, host Shadd Dales breaks down new reporting from NORML on the FBI’s latest Uniform Crime Report, revealing that in 2025, law enforcement agencies reported over 200,000 marijuana possession arrests, accounting for 23% of all drug arrests in the country, even with 24 adult-use states and 38 medical states on the books.

The numbers show marijuana possession arrests still outnumber arrests for cocaine, methamphetamine, and heroin combined, creating a patchwork where enforcement depends entirely on which state someone lives in. NORML’s data also points to a real racial disparity, arrest rates remaining significantly higher for Black and Brown communities despite similar usage rates across demographics, a pattern that hasn’t shifted even as legal markets have expanded.

There’s a breakdown of why this matters beyond the raw numbers, the human cost of possession charges, jail time, fines, employment and housing barriers, the resources law enforcement pours into enforcing possession laws for a substance that’s regulated and taxed across much of the country, and how this data lands at the exact moment the federal government is actively reviewing cannabis rescheduling.

The bigger point NORML makes is clear, state-level legalization alone hasn’t been enough to eliminate criminalization, and federal reform remains the only real fix for a country living in two completely different legal realities at once.

A hard look at the gap between where cannabis policy stands on paper and where enforcement actually is.

Government Says Marijuana Fails Schedule I Test | TDR Cannabis in 5

The federal government just made one of the clearest, most direct statements it’s ever made about marijuana’s scheduling status.

In this episode of TDR Cannabis in 5, host Shadd Dales breaks down newly released DEA hearing transcripts showing the government arguing marijuana can no longer remain in Schedule I, not based on opinion, but on the actual statutory requirements of federal law.

From there, the government made its case for exactly where marijuana belongs, Schedule III, arguing its abuse potential and dependency profile align far more closely with substances already there than with anything in Schedule I or II. This all comes from the same 11-day hearing that produced the 2,470-page transcript now sitting with Chief Administrative Law Judge Derek Julius, and it lines up directly with DEA’s own post-hearing brief from last week.
