Three months later… and still no update.

In today’s episode of TDR Cannabis in 5, presented by Flowhub, we break down the growing pressure on the Department of Justice as delays continue around federal cannabis rescheduling.

Back on December 18th, President Donald Trump signed an executive order directing the DOJ to move cannabis from Schedule I to Schedule III. At the time, markets reacted quickly — with expectations that this would move fast.

But here we are now… and nothing has changed.

According to new reporting from Marijuana Moment, Congressman Steve Cohen is now demanding answers from Attorney General Pam Bondi and the DEA, asking a simple question: where is the timeline?

This isn’t just about politics — it’s about execution.

Because while the executive order created momentum, the actual rescheduling process still requires a formal rulemaking process. And right now, that process appears stalled.

We also get into a key issue that’s flying under the radar — the DOJ missing a federal deadline tied to cannabis research reform, which only adds more pressure to an already delayed process.

For investors, this matters.

The market priced in speed… and now it’s dealing with uncertainty.

Until a final rule is published, cannabis remains a Schedule I substance — and that means no real change yet.

Facts vs. Myths About Medical Cannabis with Peter Grinspoon, MD

Cannabis laws in the United States have a tumultuous and convoluted history. Although the drug has been used in the United States since the late 1800s, it was first legalized for medical use by California in 1996. In 2012, Colorado and Washington legalized recreational cannabis. Today, medical-use cannabis is allowed in 47 states and non-medical-use cannabis is allowed in 24 states.

While most states have approved medical cannabis, the drug’s use is far from destigmatized. To learn more about cannabis’ path to legalization, place in healthcare, and possible risks, I am joined by physician and cannabis specialist Dr. Peter Grinspoon.

To begin, Peter explains that heavy criminalization charges and negative public opinion on cannabis primarily stem from the War on Drugs campaign.

“To get cannabis research in the 1970s, 1980s, 1990s, you had to show a drop in something. A drop in IQ, a drop in motivation, or a drop in sperm count, none of which are actually true. There are harms, but not those.”

Peter advocates for greater education on cannabis among healthcare professionals. The drug has been shown to help symptoms of chronic pain, insomnia, and anxiety. For the right patients, it can be a useful tool. Knowing how to dose cannabis gradually under the guidance of a medically trained professional will be crucial as public awareness of the drug grows.

Full Spectrum CBD Just Got Complicated | Here’s What Congress Did

White House Signals a “Third Lane” for Full Spectrum CBD as Hemp Rules Tighten and Marijuana Rescheduling Lags

Cannabis attorney Tom Howard argues the key development is not that an executive order legalized full spectrum CBD for Medicare, but that the White House is simultaneously pushing marijuana to Schedule III and calling for access to appropriate full spectrum CBD even as Congress’s new hemp definition (Section 781) will likely push many full spectrum products back into “marijuana” via a strict total-THC, per-container cap effective November 12, 2026. He says the order does three things: urges DOJ to finish rescheduling, directs work with Congress to update hemp’s statutory definition, and instructs HHS/NIH to develop real-world-evidence research models for hemp-derived cannabinoids. With FDA guidance late and rescheduling unfinished, Howard predicts a future “middle lane” of regulated, evidence-backed, largely non-intoxicating cannabinoid therapeutics integrated into healthcare, distinct from both intoxicating hemp products and broader marijuana legalization.

Push to legalize ‘pot for potholes’ returns to TN General Assembly Monday

State lawmakers are set to take up legislation Monday that would legalize marijuana for adult use in Tennessee. The proposal SB2440/HB2525 would allow recreational cannabis use for adults 21 and older and direct revenue from a 15% business sales tax toward road repairs.

Supporters say the funding is badly needed to address road infrastructure issues across the state, especially Tennessee’s reputation for potholes.

The bill is not new. Similar legislation was introduced- and rejected- last year.

Nashville Democrats Rep. Aftyn Behn and Sen. Heidi Campbell, are sponsoring the “pot for potholes” effort again, and have launched a website and petition to build support.

“Instead of a $58 billion pothole backlog, we can legalize cannabis, tax it and pave our roads. Other states have done it, and we can too,” Behn said in a promotional video.

Supporters point to states like Massachusetts, which has a similar population to Tennessee, and generated about $289 million in cannabis tax revenue last year.

However, some Republican lawmakers remain opposed. House Majority Leader William Lamberth raised concerns about public safety during a committee hearing last year, before the bill was voted down.

“Sure, you can fill a couple of potholes at the expense of the blood that’s going to be… on those roads from intoxicated individuals that will be using marijuana in this state,” Lamberth said during the 2025 legislative session.

Currently, about half of U.S. states have legalized marijuana for recreational use, while most others allow it in some medical capacity.

Tennessee law permits only very limited THC use, putting it closer in line with the few states (three) where cannabis remains fully illegal.

Other proposals under consideration take a more limited approach to allowing marijuana in Tennessee, including decriminalizing possession of small amounts of cannabis and allowing voters to weigh in on medical cannabis through a ballot question.
