Epic Setback In Marijuana Legalization Movement

“While medical marijuana is legal in Colorado, employers can still fire patients for using it — even if they aren’t impaired at work.

In a landmark decision Monday morning, the Colorado Supreme Court ruled that Brandon Coats, a quadriplegic medical marijuana patient from Colorado who was fired by Dish Network in 2010 for using the drug while at home and off-duty, was not protected under the state’s “lawful activities statute.”

“Although I’m very disappointed today, I hope that my case has brought the issue of use of medical marijuana and employment to light,” Coats said in an emailed statement. “If we’re making marijuana legal for medical purposes we need to address issues that come along with it such as employment. Hopefully views on medical marijuana –- like the ones in my specific case — will change soon.”

The arguments from both Dish’s and Coats’ attorneys centered on the question of what exactly constitutes “lawful” use of medical marijuana outside of the workplace — and how such use can be considered lawful when federal law still classifies marijuana as an illegal substance, even though the state of Colorado has legalized its use both medically and recreationally.”*

Majority Favors Marijuana Legalization

“For the first time in more than four decades of polling on the issue, a majority of Americans favor legalizing the use of marijuana. A national survey finds that 52% say that the use of marijuana should be made legal while 45% say it should not.”*

There are few places in the world where you can walk into a licensed shop and buy marijuana for recreational use. Uruguay is one (sold in pharmacies). Canada is another. They’re joined by 21 US states, representing 48 percent of the American population, up from zero states in 2013.

That means that in Idaho, people caught growing or selling weed face mandatory jail time and tens of thousands of dollars in fines while their counterparts next door in Washington can enroll in a state-funded mentor-ship program for cannabis business planning and development. And states like Washington are violating both US federal law which prohibits any use of marijuana, and also international law, which prohibits non-medical uses.

That’s messy. But it reflects that although large majorities agree that the criminalization of cannabis use was a mistake, there’s less consensus about how exactly to move forward.

Will Jones III, the Director of Community Engagement & Outreach at Smart Approaches to Marijuana (SAM), maintains that the commercialization of weed would lead to more harm than good. He prefers decriminalization instead, which removes criminal penalties, treating marijuana possession more like a traffic ticket. (Six US states have decriminalized recreational cannabis without legalizing.) However, SAM prioritizes fighting legalization and reducing drug use over promoting decriminalization.

SAM co-drafted the Medical Marijuana and Cannabidiol Research Expansion Act which makes it easier to study marijuana and develop marijuana-derived drugs but without descheduling marijuana as a schedule I illicit substance. President Biden signed it into law in December of 2022.

Paul Armentano, the Deputy Director of NORML, has spent decades advocating for legalization of marijuana and says decriminalization doesn’t go far enough. NORML represents the interests of cannabis consumers and has been advocating for the removal of criminal penalties for recreational marijuana since 1970.

We thought both of their perspectives were worth hearing but didn’t want to stage a traditional debate where viewers so often come away confused about what to believe. So we created a format that would help establish a shared foundation of facts while still communicating what each of these advocates believe is the most important information to know.

In this new take on a debate, we asked both participants to identify facts that their opponent would have to concede are true. They were given an opportunity to review their adversary’s facts in advance and in a video call agreed on a set of six. In the video, you’ll see those facts presented, with each participant given the opportunity to add a “footnote” to their opponent’s facts.

How America lost the war on Marijuana: Within a decade, the U.S. went from cracking down on marijuana use to becoming a $47 billion industry. But the road to having dispensaries on every corner, the smell of weed smoke freely in the air and criminal records expunged didn’t happen overnight. It took a couple of states leading the charge – Colorado and Washington in 2012 – to then ripple into near nation-wide legalization. There are now 21 states where cannabis has been legalized for recreational use. Every corner of New York City , for example, is an assault on the nostrils with people lighting up a joint as early as before or just after their morning commute. However, not everyone is on board with the marijuana revolution. Doctors and advocates have highlighted concerns about excessive use of cannabis in high risk groups, especially the youth. Weed was the real winner of the 2020 election

On November 3, four American states voted to legalize marijuana: Arizona, New Jersey, Montana and South Dakota. Combined with the other states that have done so in recent years, one in three Americans now live in a state where access to marijuana has been legalized. It shows that Americans are souring on the harsh drug policies that have put millions of people in prison.

But America’s national drug policy is a different story. Under federal law, marijuana is still classified as a “schedule 1” drug, meaning it’s considered to have little medical value and a high risk of abuse, along with drugs like LSD, heroin, ecstasy and psilocybin mushrooms. In states where marijuana has been legalized, that conflict with federal law creates numerous problems for legal marijuana sellers and users. And few national politicians talk about legalizing marijuana throughout the country. But advocates are hoping that by introducing new state laws one by one, Americans who are ready to move on from the country’s decades-long war on drugs will eventually force the federal government’s hand.

Underground Marijuana Growing Operation in Arlington

RAW video from Sky 4 of an underground marijuana growing operation. From DPS: “At approximately 9 a.m. today, Texas Department of Public Safety (DPS) Special Agents served a search warrant in the 5800 Block of Magnum Drive in Arlington. While serving the search warrant, an illegal underground marijuana grow was located in the back yard of the residence being searched.

The marijuana was found in an underground room that was completely separate from the residence. It was approximately 20 feet from the house in the backyard covered by an outdoor patio. Under the patio was a covering that led to a hole that was approximately 9 feet deep. A ladder led to the bottom of the underground location. The underground opening where the Marijuana was being grown was approximately 14 ft. by 8 ft. and contained around 100 plants.

Arlington Fire Dept. was called to the scene to ensure the underground location was structurally secure while agents collect evidence.

Two individuals were arrested at the residence: Tri Vo, age 31 and Jlicia Perry, age 26. Both suspects were transported to the Tarrant County Jail for cargo theft (Texas Penal Code 31.18). The investigation is currently underway and additional charges may be forthcoming.”

Booker introduced the Marijuana Justice Act on Feb 28, 2019, which seeks to reverse damages of the war on drugs by expunging cannabis records and giving job priority to people who were directly affected.

The 2-term mayor of South Bend, IN is an advocate for social justice In Feb 2019, he told the Boston Globe ‘The safe, regulated, and legal sale of marijuana is an idea whose time has come for the United States, as evidenced by voters demanding legalization in states across the country.’

4. Julián Castro – For
As former Secretary of Housing and Urban Development under Barack Obama, he published a memo requiring owners of federal housing facilities to deny entry to people who use cannabis, even state-legal patients. In 2017, in response to a possible crackdown by the Trump administration, Castro tweeted ‘A mistake. Colorado and other states have shown we can sensibly legalize marijuana with reasonable controls.’ Castro does not have a voting record on cannabis.

6. Tulsi Gabbard – For
The Congresswoman from Hawaii spoke about cannabis in her campaign launch speech, criticizing a criminal justice system that ‘…puts people in prison for smoking marijuana while allowing corporations like Purdue Pharma, who are responsible for the opioid-related deaths of thousands of people, to walk away scot-free with their coffers full.’

The New York Senator and former Congresswoman cosponsored Booker’s Marijuana Justice Act and has a lengthy history of supporting pro-cannabis legislation.

The California Senator is a cosponsor of the Marijuana Justice Act and SAFE Banking Act, which would allow federal banking institutions to deal with money from cannabis businesses Harris has said addiction should be treated as a public health crisis instead of a criminal justice issue She’s made cannabis legalization and social justice staples of her campaign.

The former Governor of Colorado signed the proposition to legalize cannabis statewide in 2012 At the time, he wasn’t entirely pro-legalization, and he warned other governors to approach cannabis reform with caution Hickenlooper has since advocated for states’ rights regarding cannabis legalization.

The Washington Gov. was in office when the state legalized cannabis in 2012 After announcing his 2020 bid, he said, ‘…and it’s about time we do it nationwide’ Inslee launched a ‘Marijuana Justice Initiative’ in 2019 to pardon non-violent cannabis offenders in Washington.

Inside Thailand’s First Legalised Cannabis Plantation

Thailand has become the first country in Southeast Asia to legalise the use of cannabis as a drug. Marijuana is said to be able to treat various diseases including Parkinson’s, asthma, insomnia, autism and even cancer. But there are also studies that have shown the negative effects cannabis, such as brain damage and addiction.

While hemp plants are now grown at the Royal Agriculture Pangda in Samoeng, weed remains illegal and banned in Thailand. “We will make the public understand that it’s for medical purposes only, not for recreation,” said Niyom Termsrisuk, the Secretary-General of Office of Narcotics Control Board (ONCB). The Thai military conducts search and destroy mission in the hills of Chiang Rai to rid of illegal drug plantations.

If we don’t see pot legal by 2018 I’m shaving my head. We need to make marijuana legal! #SaveCGsHair campaign! Make the weed legal please! I like my ginger locks!

Why in 2017 do we still see marijuana illegal? The cannabis legal status currently has no logical backbone! The war on drugs is fighting the wrong drugs and helping the cartel! The drug policy is senseless jibberish. We will see pot legalized at some point, why not today? I will stop at nothing until I see marijuana legalized!

The “marijuana problem” is simply the legal status of pot gives kids access to other illegal drugs. Marijuana isn’t all that benign, but at least it doesn’t cause irreversible brain damage as soon as THC crosses the blood brain barrier. If you choose to smoke marijuana, you’re not a criminal. Help me on this path to drug legalization so we stop fighting the wrong substances.
