TerrAscend was served on August 3 — more than two months after the case was filed — and just two weeks before the ALJ’s August 17 deadline. In federal practice, service timing is rarely accidental, and many observers believe this may signal strategic positioning.

TerrAscend’s response is due August 24. DOJ’s reply is expected in early or late September. Meanwhile, the ALJ’s recommendation could land around that same period.
