Opponents of cannabis rescheduling just suffered a real setback in federal court.
In this episode of TDR Cannabis in 5, host Shadd Dales breaks down reporting from Marijuana Moment on a ruling from the U.S. Court of Appeals for the District of Columbia rejecting an attempt to immediately freeze the Trump administration’s rescheduling process while broader legal challenges continue.
The request came from the National Drug and Alcohol Screening Association and MMJ International Holdings, who argued rescheduling would cause irreparable harm and increase marijuana abuse by cutting taxes on cannabis companies. The court didn’t buy it, ruling petitioners hadn’t met the “stringent requirements” for a stay. That doesn’t end the underlying lawsuits, three separate challenges, one from Smart Approaches to Marijuana and NDASA, another from a coalition including MMJ and anti-marijuana activists, and a third from the attorneys general of Indiana and Nebraska, remain consolidated before the court, with proposed briefing formats due within 30 days.
The court also denied a separate motion from medical marijuana companies trying to formally intervene on the government’s side, though they can still file amicus briefs.
Meanwhile, the DEA’s own administrative process keeps moving forward too, with the agency’s final brief arguing marijuana no longer meets Schedule I criteria, citing over 30,000 practitioners treating six million patients across 43 jurisdictions, and asking the administrative law judge to move quickly on a Schedule III recommendation.
Between the court ruling and the DEA’s own position, the pressure against rescheduling just lost real ground on two fronts at once.
