Big update out of Florida: a state appeals court just ruled that police can’t automatically search a vehicle solely based on the smell of marijuana. It might sound like a small tweak, but this decision overturns years of precedent — and it could change how cannabis laws are enforced across the U.S.

In this episode of TDR Cannabis in Five presented by Dutchie, host Shadd Dales breaks down what the court said, why it matters, and how it could reshape both policing and cannabis policy. The ruling — centered on the Darrielle Ortiz Williams case — officially overturns Florida’s long-standing “plain smell doctrine,” saying odor alone no longer establishes probable cause.

That means officers will now need more than just smell — like visible contraband or suspicious behavior — to justify a search. And it reflects a broader trend we’re seeing from Minnesota to Maryland to New York, where odor-only searches are being rolled back in recognition of hemp, CBD, and medical cannabis laws.
