With the legalization of marijuana in Illinois coming on January 1, it’s important to remember there are still laws around the use of the drug.

For example, it will still be illegal to drive while under the influence of cannabis. Though there isn’t a comparable device to the Breathalyzer for testing blood alcohol levels, police will continue to use field sobriety tests for marijuana detection.

“What the officers have to rely on is basically their initial observation of the vehicle, their driving habits, what are they doing?” said Sergeant Derek Zook of the Naperville Police Department. “And then the observation that the officers make will determine if they do a field sobriety test.”

Drivers that fail that test can be arrested and taken to the police station for blood and urine samples.

Similar to the .08 BAC threshold for alcohol, the NPD has established concentrations for THC in those tests.

It’s also illegal to consume cannabis in public. Sergeant Zook said the best place to use cannabis is in your own home.

“It’s going to be handled the same way as open alcohol,” said Zook. “You just can’t walk around Downtown Naperville with a can of beer. It’ll be the same thing. You can’t walk around Downtown Naperville or anywhere within the city and smoke marijuana.”

Naperville has not opted in to the sale of cannabis within the city’s jurisdiction, but residents could purchase products from dispensaries in other municipalities.

There will be a non-binding referendum asking residents to weigh in with their stance on recreational cannabis sales on the March 17 primary ballot.

Precinct 5 Narcotics Unit Raids Marijuana Grow House

Two suspects, Peter Nguyen, 40, and Khoi Huynh, 42, were arrested in the 8200 block of Polaris Point Ln. while harvesting marijuana from plants inside. Precinct 5’s Narcotics Unit seized more than 200 plants and 180 pounds of marijuana from within the home, which had an elaborate light and ventilation set up in several bedrooms.

no appology, not even so much as a phone call, leaving the property unlocked, gates, doors and fence panels removed and broken, property free for the other criminals of society (the ones without badges) to pick over the scraps.

these cops messed up. The law has gone too far in Australia, something has to change when a computer warrants a violation of ones privacy and a destruction of property.

No special warrant was required, they acted under their standard abuse of power “general warrant” with no permission from a magistrate to forcibly enter. even a simple phone call was too hard!

When questioned, the officer advised he has NEVER SOUGHT A MAGISTRAITS WARRANT in his entire 12yr career… thte fact nobody is keeping them in check is disgusting!

He also advised that he thought that I would be more angry if he removed the fly screen instead of kicking in the door.

He went so far as to actually say the house was just as secure as when he found it, despite admitting to causing the damage..
